INFORMATION ON THE PROCESSING OF PERSONAL DATA

Arte Marena di Nunzio Marena, with registered office in Sant’Andrea di Conza (AV) – Via San Lorenzo, 7, VAT number 03161400647, provides the privacy information pursuant to art. 13 of EU Regulation 679/16 (the “Regulation” or “GDPR”), as Data Controller of the personal data of visitors (hereinafter, “Users”) of its website https://www.artemarena.it/ (hereinafter, “Site”).

 

1) Types of data processed and purposes of processing

The processing of Users personal data will be carried out using manual and computerised tools, in order to guarantee the security and confidentiality of the data, for the following purposes:

– respond to User requests concerning the Site and/or our Services/Products (art. 6, par. 1, letter b) of the Regulation);

– if necessary, allow Arte Marena to pursue its legitimate interest in ensuring the security and integrity of the Site (art. 6, par. 1, lett. f of the Regulation).

The optional, explicit and voluntary sending of electronic mail to the addresses indicated on the Site entails the acquisition of the sender’s address, necessary to respond to requests, as well as any other personal data entered. Apart from what is specified for navigation data, the User is free to provide his/her personal data in the request forms on the Site. Failure to provide them may make it impossible to obtain the services and/or information requested. The provision of data for marketing and/or profiling purposes is absolutely optional.

2) Browsing data

The computer systems and software procedures used to operate this Site acquire some personal data whose transmission is implicit in the use of Internet communication protocols: this category of data includes IP addresses, URI (Uniform Resource Identifier) ​​addresses of the requested resources, the time of the request, the method used to submit the request to the server, the size of the file obtained in response and other parameters relating to the operating system and the User’s IT environment. These data are used for the sole purpose of obtaining statistical and anonymous information on the use of the Site, to check its correct functioning and are deleted immediately after processing. They could be used to ascertain responsibility in the event of hypothetical computer crimes against the Site.

4) Marketing

Only with prior express consent (art. 6, par. 1, letter a) of the Regulation), Arte Marena may process the User’s data for direct marketing purposes (for example sending newsletters and promotional material, commercial communications, loyalty initiatives, etc.). If the user does not express his/her consent to such optional sending, he/she is free to grant or withdraw consent at any time by contacting Arte Marena at the contact details indicated in point 9.

5) Profiling

In the event of the User’s consent, Arte Marena may process some of his/her personal data for profiling purposes, instrumental to sending personalized marketing communications. In the event that the user does not express his/her consent to such optional sending, he/she is free to grant or withdraw consent at any time by contacting Arte Marena at the contact details indicated in point 9.

6) Optional communication of data to third parties

With the User consent, Arte Marena may communicate some of his/her personal data to third-party companies, so that they can in turn process such data for marketing purposes. If the user does not express his/her consent to such optional sending, he/she is free to grant or withdraw consent at any time by contacting Arte Marena at the contact details indicated in point 9.

7) Data retention

Personal data collected in relation to products and/or services will be retained for the time required by law: those collected for marketing, profiling and communication of data to third parties will be retained until the User revokes consent, navigation data will be deleted immediately after being processed for operational or statistical purposes; in any case, such data may be used to verify any liability in the context of computer crimes against the Site. Outside of this eventuality, navigation data will be retained for a period of time equal to the minimum necessary, without prejudice to any further retention period made necessary by legal obligations.

8) Scope of communication and dissemination of data

The Users personal data may be disclosed to employees and/or collaborators of Arte Marena in charge of managing the Site. These individuals, formally appointed by Arte Marena as “data processors”, will process the User’s data exclusively for the purposes indicated in this information notice and in compliance with the legislation in force regarding the processing of personal data. The Users’ personal data may also be disclosed to third parties who may process the data on behalf of Arte Marena as “external data controllers”, such as, for example, suppliers of IT and logistics services functional to the operation of the Site, professionals and consultants, companies in charge of sending promotional emails on behalf of Arte Marena. Only in the event of accidental loss of data, the User’s data may be communicated to the judicial authority.

9) User Rights

Pursuant to Articles 15-22 of the Regulation, Arte Marena informs that Users have the right to obtain information on the origin of personal data; the purposes and methods of processing; the logic applied in the event of processing carried out with the aid of electronic instruments; the identification details of the owner and managers; the subjects or categories of subjects to whom the personal data may be communicated or who may become aware of them as managers or agents. They also have the right to obtain: a) updating, rectification or, when interested, integration of data; b) cancellation, restriction of use, transformation into anonymous form or blocking of data processed in violation of the law, including data whose retention is not necessary in relation to the purposes for which the data were collected or subsequently processed; c) certification that the operations referred to in letters a) and b) have been brought to the attention, also with regard to their content, of those to whom the data have been communicated or disseminated, except in the case in which such fulfillment proves impossible or involves the use of means manifestly disproportionate to the right protected.

Right of each user

Each user has the right to object, in whole or in part, to the processing of personal data concerning him/her:

a) for legitimate reasons, even if the data processed is relevant to the purpose of the collection;

b) for the purpose of sending advertising or direct sales material or for carrying out market research or commercial communication.

Every user has the right to data portability, that is, the right to receive from Arte Marena, in a structured format, the data concerning him/her, as well as to transmit such data to another data controller. He/she also has the right to revoke the consents given at any time, without prejudice to the validity of the processing carried out before the revocation.
